Privacy Statement

1. General information

The careful handling of your personal data is of great importance to us. Accordingly, we strictly comply with the statutory regulations when we collect, process or use personal data.

The personal data that we need to obtain from you and the purposes for which we process them are described in the following.

Personal data is information that can be assigned to you as a person (e.g. your name, your telephone number or your email address). Personal data do not include data of juristic persons or information that cannot be associated directly with your actual identity.

2. Collection and use of personal data

Information that we obtain from you helps us to individualise and continuously improve our services. We use that information to handle your orders. Unless you have provided your data to us exclusively for the purpose of contacting you (see Section 4), we may use your data also to communicate with you about orders, products or services and to send you marketing offers (see “Communication by email” below) and to update our data records, administer your data and recommend products or services you might be interested in. We may also use your data to improve our range of products and our platform, to prevent or detect misuse of our website or to enable third parties to provide technical, logistical or other services on our behalf.

Of course, you can at any time object to the processing or use of your personal data for advertising purposes by sending an informal notice to info@knick.de or by using our online form.

Whenever our website is accessed, our system will automatically acquire data and information about the computer system of the accessing computer.
The following data will be acquired:

  • Information about the browser type and version used
  • The user’s operating system
  • Date and time of access
  • Websites from which the user’s system gets to our website
  • The data are also stored in the log files of our system. This does not apply to the user’s IP addresses or other data that would allow assignment of the data to a user. These data will not be stored together with other personal data of the user.

Information about you is also actively collected on our website. You can use an online form provided on our website to contact Knick. We will use the personal data transmitted in connection with this exclusively to handle your contact request and will delete them, unless any legal retention periods apply that prevent such deletion. The legal basis for the processing of the data is Art. 6.1, first sentence, Letter (b) GDPR if your contact request relates to the initiation or performance of a contractual relationship between you and us. In other cases, the legal basis is Art. 6.1, first sentence, Letter (f) GDPR. Your data will not be transmitted to any third party.

To contact you, the following data about you will be acquired and stored:

• Full name
• Company name
• Email address
• Full telephone number (if provided)
• The consent to the Data Privacy Statement
• Additional data relating to your request, if any
(hereinafter referred to as “personal data”)
As an alternative, we may use the email address provided to contact you. In this case, the user’s personal data transmitted with the email will be stored. To enable us to make the emails we send you more useful and more interesting, we often receive a confirmation about which of our emails you open, provided that your computer supports this function.

3. Application

You can use the email address karriere@knick.de to apply for a job that we offer or to send us an unsolicited application and to submit your documents to us.

We process personal data which you provide to us in the context of the application process and which are required to determine your professional and personal skills in relation to the position to be filled on the basis of Section 26 BDSG or, in the pre-contractual relationship, in accordance with Art. 49.1, Letter (a) GDPR. Without your consent, your data will not be transferred to a third party.

When you send an application by email or via our recruiting page using the applicant form, you indicate your interest in taking up employment with us. In this context, you send us personal data which we will use and store exclusively for the purpose of your search for employment/application and in case we have follow-up questions.

Moreover, meaningful documents, such as a cover letter, your curriculum vitae or reference letters, can be emailed or uploaded via the applicant form. Such documents may contain additional personal data, such as date of birth, address etc.

Your data will be treated as confidential and can be accessed only by persons necessarily involved in the application process.

The data in the applicant form provided in the context of your application will be transmitted using TLS encryption.

All data which we receive from you as an applicant will be stored in a database. This database is operated by Personio GmbH, a supplier of personnel administration and applicant management software https://www.personio.de/impressum/. In this regard, Personio is our processor pursuant within the meaning of Art. 28 GDPR. The processing activities are based on a data processing agreement concluded between Personio and us as the controller. Your data will be stored exclusively within the European Union.

As a rule, we will delete your personal data as soon as they are no longer required for the abovementioned purposes, usually six months after completion of the application process, unless an employment relationship is established and you authorise us to process the data for other applications. If you authorise us, the six-month deletion period commences upon completion of the other application process. We will keep your application on record for a maximum of two years only with your consent.

4. Purposes of collection, processing and use

Knick Elektronische Messgeräte GmbH & Co. KG will collect, process and use the personal data exclusively for the following purposes:

  • To contact you to verify the data
  • To contact you to handle requests
  • To set up and manage a customer account
  • To process your application and to contact you in this respect
  • To send you newsletters

Knick Elektronische Messgeräte GmbH & Co. KG will use the personal data for any purpose other than one of the purposes specified above only where this is necessary to safeguard the legitimate interests of a third party or to prevent threats to state or public security or to prosecute criminal offences.

The personal data will be stored and processed exclusively on servers located in the European Union.

5. Duration of the use of data

The personal data will be deleted immediately if you withdraw your consent or if the purpose of the use of the data no longer exists.

Compelling legal requirements, in particular retention periods, are not affected.

Knick Elektronische Messgeräte GmbH & Co. KG will without delay inform its cooperation partners if the consent given to Knick Elektronische Messgeräte GmbH & Co. KG is withdrawn. Knick Elektronische Messgeräte GmbH & Co. KG has obliged its cooperation partners to delete the personal data without delay after they have been informed of such withdrawal.

Moreover, Knick Elektronische Messgeräte GmbH & Co. KG has obliged its cooperation partners to inform Knick Elektronische Messgeräte GmbH & Co. KG without delay if the consent given to a cooperation partner is withdrawn. As soon as Knick Elektronische Messgeräte GmbH & Co. KG has been informed of any such withdrawal of consent, it will without delay procure that it and, if applicable, any cooperation partner will delete the data.

6. Data security and data protection, communication by email

Knick Elektronische Messgeräte GmbH & Co. KG applies appropriate technical and organisational processes to prevent unauthorised access or unauthorised disclosure and to guarantee the accuracy of the data and to ensure authorised use of the data. Nevertheless, electronic communication is never entirely secure. Accordingly, all data and information that you voluntarily transmit to Knick Elektronische Messgeräte GmbH & Co. KG might be acquired by a third party by means of unlawful data retrieval. Knick Elektronische Messgeräte GmbH & Co. KG cannot assume any liability for the disclosure of data due to errors and/or unauthorised access during data transmission by third parties.

We can also not guarantee complete data security of email communication. We therefore recommend to send data by letter if they require a high level of secrecy.

7. SSL or TLS encryption

For security reasons and to protect the transmission of confidential contents you send to us as the operator of the sites, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the browser’s address line changing from “http://” to “https://” and by the lock icon in your browser line.

If SSL or TLS encryption is active, third parties cannot read the data that you send us.

8. Newsletter

You can subscribe to a free newsletter. When you register for the newsletter, you will receive an email asking you to confirm your newsletter subscription. This is to ensure that no third party has misused your data (double-opt-in principle).

After registration, you will be sent information about what’s new at Knick and other contemporary topics. If you no longer wish to receive the newsletter, you can unsubscribe at any time inside the newsletter.

Your personal data will not be given to third parties for advertising purposes.

We use the email service provider Brevo/ Sendinblue (ehemals Newsletter2Go), offered by Sendinblue GmbH, Köpenicker Str. 126, 10179 Berlin, to send our newsletter. If you register for our newsletter, your email address and the other personal data that you have provided upon registration will be transmitted to and processed and stored by Brevo/ Sendinblue. Brevo/ Sendinblue will use these data to send and evaluate the newsletter on our behalf.

We have concluded a commissioned data processing agreement with Brevo/ Sendinblue to ensure that Brevo/ Sendinblue will process your personal data only in accordance with our instructions and only on our behalf. Brevo/ Sendinblue has taken appropriate technical and organisational measures to ensure that your personal data will be processed only in accordance with our instructions and, in addition, Brevo/ Sendinblue is certified by TÜV Rheinland.

Brevo/ Sendinblue can use the recipients’ data in a pseudonymised form, i.e., without assignment to a user, to optimise or improve its own services, e.g. for the technical optimisation of the mailing and representation of the newsletters or for statistical purposes. However, Brevo/ Sendinblue will not use the data of our newsletter recipients to write to them or to transmit the data to a third party.

9. Sweepstakes

We will run sweepstakes on our website from time to time. When we do this, we will collect, process and store the personal data, such as given name, surname, email address and address, that are necessary to run the sweepstakes. In individual cases, it may be necessary to register on our website with a user account.

Supplementary terms and conditions apply to each sweepstake, which you will need to accept separately to be able to participate. Among other things, these conditions of participation include detailed information about the extent and use of the data collected, processed and stored in the context of the performance of the sweepstake. Should any of the provisions relating to the processing of your personal data conflict with this Data Privacy Statement, the provisions of the sweepstake will take precedence. This may be the case, for instance, if extended or altered data protection regulations apply in the conditions of participation of a sweepstake.

10. Cookies

Some of the services of this website use cookies. Cookies are small text files that contain information to identify visitors that return to the website exclusively for the duration of their visit to the website. They make it easier to use the online offering of www.knick-international.com. They are stored by your browser on the hard disk of your computer and do no harm there.

We will disclose the information that we receive from you to third parties exclusively to the extent described below:

Service providers: We commission other enterprises and individuals to carry out tasks for us. Examples include the sending of letters or emails. These service providers will receive only the data that are necessary to carry out their tasks. They are not permitted to use these data for any other purpose. In addition to this, they are obliged to treat the data in compliance with this Data Privacy Statement and the German data protection acts.

Protection of Knick and third parties: We will disclose personal data of users if we are under a legal obligation to do so or if such disclosure is necessary to enforce our General Terms and Conditions or any other agreement or to protect our rights or the rights of our users or of a third party. For the avoidance of doubt, we expressly state that, in connection with this, the data will not be disclosed to these enterprises to make any use of them for economic purposes contrary to this Data Privacy Statement.

With your consent: In all other cases, we will inform you when personal data are to be disclosed to a third party and in this way give you the opportunity to give your consent.

Whenever personal data are disclosed to a third party to the extent described above and whenever data are transmitted to countries outside of the European Economic Area (EEA), we will ensure that the data will be transmitted in compliance with this Data Privacy Statement and the German data protection acts.

12. Google Analytics

This website uses Google Analytics, a web analysis service provided by Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Google Analytics uses so-called cookies, i.e., text files which are stored on the user’s computer and enable an analysis of the use of the website. The information generated by the cookie about your use of this website will usually be transmitted to and stored by Google on servers in the United States. However, if IP anonymisation is activated on this website, Google will – within the member states of the European Union and other contracting states of the Treaty on the European Economic Area – truncate your IP address prior to transmission. If you have given your consent, Google Analytics 4, a web analysis service provided by Google LLC, will be used on this website. The controller for users in the EU/the EEA and in Switzerland is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”).

Scope of the processing
Google Analytics uses cookies that enable an analysis of the use of our websites by you. The information gathered by the cookies about your use of this website will usually be transmitted to and stored by Google on servers in the United States.

In Google Analytics 4, the anonymisation of IP addresses is activated by default. Due to the IP anonymisation, Google will – within the member states of the European Union and in other contracting states of the Treaty on the European Economic Area – truncate your IP address. Purposes of the processing
On behalf of the operator of this website, Google will use this information to evaluate your pseudonymous use of the website and to compile reports on website activity. The reports provided by Google Analytics are used to analyse the performance of our website.

It cannot be ruled out that US-American authorities may access the data stored by Google.

Transfer to third countries
Where data are processed outside of the EU/the EAA and the level of protection of personal data is not equivalent to the European standard, we have agreed on EU Standard Contractual Clauses with the service provider to establish an adequate level of protection of personal data. The parent company of Google Ireland, Google LLC, has its registered office in California, USA. Transfer of data to the USA and access by US-American authorities to the data stored by Google cannot be ruled out. In terms of data protection law, the United States are currently regarded as a third country without an adequate level of protection. You do not have the same rights there as within the EU/the EEA. You may not be entitled to any legal remedies against access by the authorities. By giving your consent to the use of this service, you also give your consent to the transfer of data in accordance with Art. 49.1, Letter (a) GDPR.

Duration of storage
The data transmitted by us which are linked to cookies will be deleted automatically after 14 months. Data the retention period of which has expired are automatically deleted once a month.

Legal basis
The legal basis for this data processing is your consent in accordance with Art. 6.1, first sentence, Letter (a) GDPR in conjunction with Art. 49.1, Letter (a) GDPR.

Withdrawal
You can withdraw your consent at any time with future effect by accessing the cookie settings Privacy Statement and changing your settings there. This does not affect the lawfulness of the processing based on the consent before its withdrawal.

You can also prevent the storage of cookies beforehand by making appropriate settings in your browser software. However, if you configure your browser to reject all cookies, the functionality of this and other websites may be restricted. In addition, you can prevent acquisition of the data generated by the cookie that relate to your use of the website (including your IP address) and the processing of these data by Google

13. YouTube

Our website uses plug-ins of the YouTube video portal. The provider is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit one of our websites that shows a YouTube video, your browser will establish a connection with the servers of YouTube. For technical reasons, it is then also communicated to the YouTube server which of our sites you have visited. Moreover, if you are logged on to your YouTube account, you enable YouTube to directly assign your surfing behaviour to your personal profile. You can prevent this by logging out of your YouTube account. The use of YouTube and the possible transfer of data to the USA, and hence to a third country without an adequate level of protection, take place based on your consent given in accordance with Art. 49.1 (a) GDPR. You can at any time revoke your consent with future effect. To exercise your revocation, please deactivate this service using the “cookie consent tool” provided on the website.

14. Google Ads

On some of our websites, we do online advertising using the “Google Ads” tool offered by Google Inc. and, doing so, we also use so-called conversion tracking. When you click on an advertisement we have placed with Google, a cookie for conversion tracking is stored on your computer. These cookies will become invalid after 30 days, do not contain personal data and are hence not used to personally identify you.

When you visit certain internet pages of our website and the cookie has not yet expired, Google and we can see that you have clicked on the advertisement and have been redirected to that page. Each advertiser receives a different cookie, so that it is impossible to track cookies of different Google Ads customers.

The information gathered with the help of the conversion cookie is used to prepare conversion statistics for advertisers that have opted for conversion tracking. The advertisers are informed of the total number of users that have clicked their advertisement and have been redirected to a page provided with a conversion tracking tag, usually the order confirmation page. However, they will not receive information that can be used to personally identify users.

If you do not wish to participate in the tracking, you can object to this use by preventing the storage of the cookies by making appropriate settings in your browser software. 15. Google Tag Manager

We use the Google Tag Manager on our websites. The Google Tag Manager is offered by Google and is a solution that we can use to manage website tags via a user interface (and, e.g. to integrate Google Analytics and other Google marketing services into our online offering). The Tag Manager itself does not process personal data. However, a connection to Google will be established when our websites are accessed and your IP address will also be processed by Google. Use of the Google Tag Manager is necessary to technically implement our online offerings. This is a legitimate interest within the meaning of Art. 6.1, first sentence, Letter (f) GDPR. To protect your personal data, we use the Google Tag Manager with the anonymisation function.

16. Google reCAPTCHA

We use the reCAPTCHA function on our website. The provider is Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland. The service includes the transmission to Google of the IP address and, possibly, of other data that Google requires for the reCAPTCHA service. By using this function, we protect our website against spam software and misuse by non-natural persons, i.e., non-human visitors. This is a legitimate interest within the meaning of Art. 6.1, first sentence, Letter (f) GDPR. To protect your personal data, we use Google reCAPTCHA with the anonymisation function.

17. Use of LinkedIn Ads, LinkedIn Marketing

We use the analysis and conversion tracking technology of the LinkedIn platform on our website. The LinkedIn technology mentioned above enables us to show you more relevant advertisements based on your interests. Moreover, we receive from LinkedIn aggregated and anonymous reports about advertising activities and information about how you interact with our website. The statistical evaluation of the user behaviour enables us to improve our offer and to make it more interesting for you as the user. This also constitutes our legitimate interest in the processing of the abovementioned data by the third-party provider. The legal basis is Art. 6.1, first sentence, Letter (f) GDPR. 18. Tawk.to

Our website offers the use of the chat plug-in provided by Tawk.to Inc. (Tawk.to). This is a live chat software we use to enable you to chat with us in real-time or to leave us a message.

The chat is integrated in the source text. This is enabled by means of a script. Cookies are used to implement the technical functions. They create a pseudonymised connection to the chat plug-in. For this, a connection to the servers of Tawk.to in the USA is established as soon as the chat is started.

When the chat is used (live chat, offline message), the following personal data are acquired:

  • Name
  • Email address
  • Chat history
  • IP address at the time of the chat
  • Country of origin

These data are not disclosed to any third party and exclusively serve the purpose of protection and for internal statistics. The data are not used to identify you. They are not stored. They will be deleted after the chat.

The personal data are processed on the basis of Art. 6.1 (b) GDPR.

Tawk.to Inc. guarantees to comply with the requirements of the GDPR as it comes into force (currently available only in English). 19. Google Maps

Our website uses the product Google Maps API provided by Google Inc. (Google Inc., 1600 Amphitheatre Parkway, Mountain View, California, 94043). When Google Maps is used, Google will also acquire, process and use data concerning the use of the maps functions by the visitors of the websites. For information about the processing of data by Google see the Google data privacy statements. They are available at www.google.com/privacypolicy.html.

The use of Google Maps and the possible transfer of data to the USA, and hence to a third country without an adequate level of protection, take place based on your consent given in accordance with Art. 49.1 (a) GDPR. You can at any time revoke your consent with future effect. To exercise your revocation, please deactivate this service using the “cookie consent tool” provided on the website.

20. Call tracking

Our website uses a service provided by matelso GmbH, Stuttgart. When you call a telephone number provided to us by matelso, information about the telephone call will be transferred to a web analysis service that we use (e.g. Google Analytics). matelso will also read cookies or other parameters of the website you visit that our analysis service has placed, e.g. referrer, document path, remote user agent. The relevant information will be processed by matelso in accordance with our instructions and stored on servers within the EU. More detailed information is available at https://matelso.com/de/privacy-statement. You can prevent the storage of cookies by making appropriate settings in your browser. However, please note that if you do this you may not be able to use the full functionality of this website.

21. Microsoft Bing Ads

(1) The website uses the “Bing Ads” remarketing function provided by Microsoft Corporation One Microsoft Way, Redmond, WA 98052-6399, USA. (“Microsoft Advertising”). Microsoft Bing Ads stores a cookie on your computer if you came to our website via a Microsoft Bing advertisement. This allows Microsoft Bing and us to detect that someone has clicked on an advertisement, was redirected to our website and has reached a specific target page previously determined (conversion page). We will only be informed of the total number of users that have clicked on a Bing advertisement and then were redirected to the conversion page. Personal information about the user’s identity will not be disclosed.

(2) If you do not wish Microsoft to use information about your behaviour as explained above, you can reject the placing of a cookie that is required for this, e.g. by making a browser setting that deactivates the automatic placing of cook1ies altogether.
